2. Eligibility
To use this Platform, you must:

Have the legal capacity to enter into binding contracts.
For Sellers: Provide accurate business details and comply with all applicable laws, including tax, trade, consumer protection, and intellectual property laws in your jurisdiction.
3. Nature of the Platform
MyShopPinoy is an online marketplace connecting Buyers and Sellers. We do not own, sell, or deliver products, nor are we a party to transactions between users. All purchases are made directly between Sellers and Customers.
4. Account Registration
Users must register to access full features. You agree to:
Provide accurate, complete, and truthful information.
Keep your password confidential and notify us immediately of any unauthorized account use.
Accept responsibility for all activities under your account.
We reserve the right to suspend or terminate any account that violates these Terms.
5. Seller Obligations
Sellers agree to:
Accurately and honestly list products, including descriptions, pricing, and availability.
Fulfill orders promptly and provide professional customer service.
Handle returns and customer service in accordance with applicable laws and individual seller policies.
Comply with all applicable laws and regulations in your jurisdiction, including those against counterfeit and prohibited goods.
Grant MyShopPinoy a non-exclusive, royalty-free license to use their listings for marketing.
6. Customer Obligations
Customers agree to:
Provide accurate shipping and payment information.
Not engage in fraudulent, abusive, or harmful activity.
Respect Sellers’ rights and comply with Platform rules.
7. Product Listings and Sales
Sellers are responsible for the legality, quality, and accuracy of their listings. Buyers should review product information carefully before purchase. All transactions are at your own risk.
8. Payments and Fees
Payments are processed via trusted third-party gateways.
MyShopPinoy may charge Sellers commissions or fees as outlined in our fee schedule.
Sellers are responsible for taxes arising from their sales.
MyShopPinoy is not liable for payment failures or errors caused by users or payment providers.
9. Delivery, Returns, and Refunds
Sellers handle shipping, delivery, returns, and refunds in compliance with applicable laws and their own policies. Buyers should consult individual seller policies prior to purchase.
10. Dispute Resolution Between Users
MyShopPinoy may assist in disputes but is not obligated to mediate. Any resolution offered is final and at our sole discretion. Users agree to attempt resolution amicably before escalating disputes.
11. Intellectual Property
Content owned by MyShopPinoy (excluding user content) is protected by applicable intellectual property laws and may not be used without permission.
Sellers retain ownership of their listings but license MyShopPinoy to use such content for promotion.
12. Data Privacy
We collect and process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and our Privacy Policy.
By using the Platform, you consent to our data handling practices.
Users are responsible for compliance with data privacy laws applicable in their jurisdiction.
13. Prohibited Conduct
Users shall not:
Engage in illegal, fraudulent, or abusive activities.
Post counterfeit, prohibited, or infringing products.
Harass or defame other users.
Attempt unauthorized access or disrupt Platform operations.
Violations may lead to account suspension or legal action.
14. Indemnity
Users agree to indemnify and hold MyShopPinoy harmless from any claims, losses, damages, or liabilities arising from their violation of these Terms or misuse of the Platform.
15. Termination
MyShopPinoy may suspend or terminate user accounts for violations or at its discretion. Termination does not absolve users of liabilities incurred before termination.
16. Limitation of Liability
MyShopPinoy provides the Platform “as-is.” We disclaim liability for:
Seller misconduct or product quality issues.
Transaction errors or user input mistakes.
Service interruptions or data loss.
To the maximum extent permitted by law, we exclude all indirect, incidental, or consequential damages.
17. Governing Law and Venue
These Terms are governed by the laws of England and Wales.
Any disputes will be resolved exclusively in the courts of England and Wales.
18. Changes to Terms
We may update these Terms at any time with reasonable notice via email or on the Platform. Continued use after changes means acceptance.
